LEGAL NOTICE & DISPUTE RESOLUTION

Effective Date: 16 August 2026

This Legal Notice governs your access and use of the e-commerce store carolbeautyhealth.com (the "Website"), operated exclusively by CAROL BEAUTY & HEALTH HOLDING LIMITED (the "Company"), a private limited company incorporated under the laws of the Hong Kong Special Administrative Region (HKSAR) with Business Registration No. 80413168.

By browsing this Website, placing an order, or completing any commercial transaction with us, you acknowledge that you have read, understood, and agree to be bound by all provisions set out in this Legal Notice, together with our Return and Refund Policy, Shipping Policy, Privacy Policy, and Terms of Service.

1. DISPUTE RESOLUTION & MANDATORY BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

A. For Customers Located in the United States of America

Any dispute, claim, or controversy arising out of or relating to your order, our products, the Website, or these terms shall first be resolved through good-faith direct negotiation between you and our Company via email (support@carolbeautyhealth.com).

If a resolution cannot be reached within thirty (30) days of initial contact, YOU AND CAROL BEAUTY & HEALTH HOLDING LIMITED AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL-ONLY BASIS BY BINDING ARBITRATION administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

  • CLASS ACTION WAIVER: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person's claims unless mutually agreed upon.
  • VIRTUAL HEARINGS: To minimize travel and legal expenses, all arbitration hearings shall be conducted virtually (via teleconference or video conference) or based solely on written submissions, unless the arbitrator determines an in-person hearing is mandatory.
  • ARBITRATION FEES: Allocation of fees shall be governed by the AAA Consumer Arbitration Rules.

B. For Customers Located in Canada

We encourage Canadian consumers to contact us first to resolve any issues on an individual case-by-case basis. Nothing in this Legal Notice seeks to exclude or restrict statutory consumer rights conferred under applicable Canadian provincial or federal consumer-protection legislation (including the Ontario Consumer Protection Act and Quebec CPA). To the extent any provision herein conflicts with mandatory Canadian consumer law, such provision shall be deemed void, and the dispute shall be resolved in accordance with applicable Canadian laws.

C. For Customers Located Outside the USA and Canada (All Other Regions)

Where you are resident outside the United States and Canada, any dispute arising out of your transaction shall first be resolved by mutual negotiation. If negotiation fails, such dispute shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region (HKSAR), and shall be governed by the laws of Hong Kong.

D. Final Fallback Jurisdiction

If the mandatory binding arbitration provisions stated in Sections 1(A) or 1(B) are deemed inapplicable, invalid, or unenforceable by a competent court of law in your jurisdiction, you expressly agree that any remaining legal action, lawsuit, or judicial proceeding shall be brought exclusively in the courts of the Hong Kong Special Administrative Region (HKSAR), and shall be governed exclusively by the laws of Hong Kong.

2. LIMITATION OF LIABILITY & SKINCARE SPECIFIC DISCLAIMER

Subject to mandatory statutory laws which cannot be excluded, CAROL BEAUTY & HEALTH HOLDING LIMITED, its directors, staff, and supply-chain partners shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of our Website or products.

A. Skincare & Cosmetic Products Disclaimer

Our skincare and beauty products are formulated for general cosmetic use. Individual skin reactions, sensitivities, or allergies may occur due to varying skin types and environmental factors.

  • PATCH TEST REQUIREMENT: It is the customer’s sole responsibility to review the full ingredient list provided on the packaging and perform a localized skin patch test before full application. The Company shall not be held liable for foreseeable reactions if the customer has a known preexisting allergy to any stated ingredient.

B. Financial Liability Cap & Evidentiary Mandate

Where permitted by applicable local law, our total aggregate financial liability to you in respect of any single order—including claims for skin reactions, medical expenses, or allergies—SHALL BE STRICTLY LIMITED TO THE LESSER OF: (a) Three (3) times the total amount you actually paid for the specific product causing the reaction; OR (b) A maximum cap of USD $200.00 (or equivalent in your local currency).

To qualify for any review, settlement, or maximum capped compensation under this section, the customer MUST strictly provide all mandatory photographic and medical doctor certificate evidence as specified in Section 4 of our Return and Refund Policy within thirty (30) days of product delivery. Failure to provide such evidence completely absolves the Company of any liability.

3. GOVERNING LAW

  • For US Customers: Arbitration proceedings shall respect mandatory consumer-protection laws of your state of residence; the arbitration agreement itself shall be governed by the United States Federal Arbitration Act.
  • For Canadian Customers: Mandatory provisions of applicable Canadian federal and provincial consumer-protection legislation shall prevail over these terms.
  • For All Other Regions: These terms, the operation of the Website, and all sales contracts are governed exclusively by the laws of the Hong Kong Special Administrative Region (HKSAR).
